    LANDBACK is a movement that has existed for generations with a long legacy of organizing and sacrifices to get Indigenous Lands back into Indigenous hands. The LANDBACK movement advocates for a transfer of decision-making power over lands to Indigenous communities. The movement does not ask current residents to vacate their houses but maintains that Indigenous governance is possible sustainable and preferred for public lands. These lands include hallmark like Mt. Rushmore.

    Home land laws regulate the ability for individuals to buy inherit or own land. These laws often require the buyer or holder of land to be 50% or more native to the region and prohibit those who are considered 'non-native' from acquiring land. Home land laws have been implemented in jurisdictions around the world e.g. in Hawaii.

  • This house would recognize the Legal Personality of the natural regions of Latin America.

    The Legal Personality is the recognition of the rights of which an entity can enjoy or demand compliance from the State. When Nature is recognized as a Legal Personality, it implies that natural regions can be holders of rights such as their care and repair through representatives who protect the interests of Nature. An example of this may be the Whanganui River in New Zealand; said river whose resources were exploited was defended in a lawsuit against the New Zealand State by a Maori tribe which lives in it and has a spiritual connection with it. Upon winning the lawsuit, the Legal Personality of the River was recognized, which created a distinction between the protection of the rights of the tribe (eg economic compensation) and the rights of Nature (eg Restoration of its environment).

  • This house believes that Papuan exploitation should be a mitigating factor in court rulings for punishing the perpetrators from West Papua National Liberation Army

    On September 17th 2021 The West Papua National Liberation Army (WPNLA) has claimed responsibility for the burning of public buildings including a clinic a bank office a school building and a market and an attack by 50 individuals against six medical workers at a village in the town of Kiwirok of Pegunungan Bintang district. Four medical workers jumped into a ravine to hide themselves from the attackers and one of them was found dead. A joint rescue team identified a nurse who suffered stab wounds in the back also a doctor who broke his arm after being hit with an iron stick by the attackers. Based on witness’ reports one of the nurses Gabriella Meilani was sexually assaulted and brutally murdered before being thrown from the cliff. Mitigating factors include any facts or circumstances thet lessens the severity or culpability of crimes.

    In July 2021, the Papua Special Autonomy Law (UU Otsus Papua) was revised and included 4 changes, which includes: 1. Prioritizing native Papuan people in political recruitments, mandating for a quarter to be not affiliated with political parties in the last 5 years, 2. A minimal of 30% of the representatives must be native Papuan women, 3. A raise of the funding for the special autonomy from 2% to 2,25% of the national funding, 4. A larger percentage of the funding must be spent on welfare, specifically education, nutrition, infrastructure, and the protection of indigenous communities.
