    (Motion 2) In the Philippines, the National Integrated Protected Areas System Act of 1992 (NIPAS Law) is a law that establishes a system for managing and protecting the country’s critical natural areas to ensure their preservation for future generations. Some protected areas in the Philippines overlap with ancestral lands (e.g., Batanes Protected Landscape and Seascape, Mt. Apo Natural Park, Coron Island, etc.), thus restricting the rights of indigenous people to use and manage their ancestral lands by restricting traditional indigenous practices that could harm ecosystems, prohibiting extractive and commercial activities to maintain environmental integrity, and placing these lands under government control through management bodies like the Protected Area Management Board. The said restriction is perceived to contradict the Indigenous Peoples’ Rights Act of 1997 (IPRA Law).

    For the purposes of this debate, John Trengove both wrote and directed the 2017 movie, Inxeba (The Wound) The film portrays the Xhosa initiation ritual, Ulwaluko, which is a deeply private and sacred tradition. As well as, the film depicted a same-sex relationship within the context of the initiation ceremony. The film had limited box office success, some critical acclaim and severe backlash. Steven von Trier, an accomplished director, had in 2017 offered John Trengove a significantly more substantial amount of money to use the script. Steven von Trier would produce the film and filter the controversial scenes. John Trengove, will still be credited as the writer.

  • That Māori should pursue redress for colonisation through novel legal claims rather than through the Waitangi Tribunal.

    Māori can seek redress for the injustices of colonisation in one of two ways. Since 1975, Māori have sought redress through the Waitangi Tribunal, a permanent Commission of Inquiry that is empowered to investigate alleged breaches of the Treaty of Waitangi (an agreement that protects Māori's right to self-determination). The Tribunal can make non-binding recommendations which form the basis of negotiations and a potential settlement between tribes (iwi) and the New Zealand Government. Settlements typically include an apology, financial compensation and the return of some land. Recently, some Māori have successfully achieved similar outcomes through novel legal claims, e.g. on the basis that the Government had a duty to protect Māori which they had not fulfilled. These claims have been successfully argued in overseas jurisdictions without similar tribunals.
